DIR-3 KYC: who must file, and the cost of missing 30 September
Deactivation of the DIN, the reactivation fee, and the practical sequence for a company with several directors.
Deactivation of the DIN, the reactivation fee, and the practical sequence for a company with several directors. This note is one of a series of factual compliance notes published by Lalit Mohan Tyagi & Co.; it is general information, not advice for a specific person or entity. Read the full note below, or see the compliance calendar for the underlying due dates.
Every person holding a Director Identification Number as on 31 March must complete the KYC exercise by 30 September of that year. This applies whether or not the person is currently a director of any company, and whether or not the DIN is in use.
A person filing for the first time, or where any particular has changed, files Form DIR-3 KYC. Where nothing has changed since the last filing, the web-based service is sufficient.
Missing the date deactivates the DIN. Reactivation requires filing the form with the prescribed fee, and until it is done the person cannot be appointed, cannot sign filings, and any form requiring that DIN will be rejected.
For a company with several directors the practical sequence is to confirm each director's registered mobile number and email in advance, since both are verified by one-time password at the time of filing, and a director travelling at the end of September is the most common reason the filing slips.
